Privacy policy, website www.noodz.it.

This privacy policy explains which Personal Data are collected by Noodz srl (hereinafter "Noodz") and how such Personal Data are used when the User uses the Noodz website and web services, accessible at the address www.noodz.it (hereinafter the "Site"), and is provided pursuant to Article 13 of Legislative Decree No. 196/2003 (Personal Data Protection Code – hereinafter the "Code") and Article 13 of Regulation (EU) No. 2016/679 (General Data Protection Regulation – hereinafter the "GDPR").
This policy does not apply to Personal Data collected by other websites that the User may visit through links to external third-party pages. Noodz is not responsible for the privacy policies and/or practices of third parties. When linking to another site or using a third-party service, you should read the privacy policy of that site or service.

"Personal Data" means any information relating to an identified or identifiable natural person, including indirectly, by reference to any other information.

Noodz may periodically amend, supplement or update this policy, including in the light of any changes to the applicable legislation. Amendments and updates to the policy will apply and will be brought to the attention of data subjects as soon as they are adopted, by means of a link to the privacy policy on the Site. Consequently, every interested User is invited to visit the Site regularly to check the updated policy. 

Processing of Personal Data
Access to certain sections of the Site and/or any requests for information or services made by Users of the Site may be subject to the provision of Personal Data; in addition, any contact with Noodz, for example through the consumer service, or the optional, explicit and voluntary sending of messages, by e-mail or by ordinary mail, to the Noodz contact details indicated on the Site, entails the subsequent acquisition of the sender's address, including e-mail address, or telephone number, which are necessary in order to respond to the requests, as well as of any other Personal Data included in the relevant communications.
The processing of the above Personal Data by Noodz, as Data Controller, will be carried out in compliance with the Code and the GDPR. 
The purpose of this policy is to enable Users to know, even before accessing the various sections of the Site and providing their Personal Data, how Noodz processes Users' Personal Data; the User must read it before providing their Personal Data by filling in the appropriate fields in the various sections of the Site.

Purposes of the processing
Depending on the needs expressed from time to time by the User accessing the various sections of the Site, the purposes of the processing of Personal Data provided directly by Users may be the following:

1. to enable registration on the Site, which is necessary in order to access particular sections of the Site and to provide and manage the various services offered;
2. subject to the User's prior consent and until such consent is withdrawn, to carry out marketing activities (such as, by way of example only and without limitation, sending promotional and advertising material, communications about marketing campaigns or promotions, carrying out related analyses on registered users and customer satisfaction surveys enabling Noodz to improve the services and products offered to its customers), including by e-mail, WhatsApp, SMS, telephone calls or ordinary mail; the User may opt out of receiving this type of communication at any time;
3. subject to the User's prior consent and until such consent is withdrawn, to send newsletters providing updates on all the news on the Site and other news about the world of Noodz;
4. to provide assistance and respond to Users' requests relating to Noodz products, advertising or the Site ("Contacts" section of the Site);
5. Social Networks: to offer advertising and engage the User on Noodz's Social Networks (for example Facebook, Twitter, Instagram, Pinterest, etc.) through the use of Personal Data deriving from the User's interaction with third-party Social Network features (such as the "Like" features). By consulting the privacy policies of the relevant third-party Social Networks, the User can learn more about how these features work, which profile Personal Data Noodz obtains, and how to opt out;
6. order-related communications: if an order is placed on the e-commerce platforms, Noodz will use the User's Personal Data to process and ship the orders and to send an order confirmation e-mail, a shipping confirmation e-mail and an e-mail requesting feedback on the service received. This processing of Personal Data is necessary for the performance of Noodz's services; therefore, the legal basis for this processing of Personal Data is Article 6(1)(b) of the GDPR. Please note that the User is contractually required to provide such Personal Data and that without them Noodz will not be able to send communications relating to the User's order; 
7. legal reasons or merger/acquisition: if Noodz is acquired by or merged with another company, it may share your Personal Data with any lawful successor. Noodz may also disclose your Personal Data to third parties (a) where required by applicable law; (b) in order to respond to legal proceedings; (c) in order to respond to a request from a competent law enforcement agency; (d) in order to protect its rights, privacy, safety or property (e) in order to enforce the terms of any contract or the terms of its website.

Registration of Users on the Site is not required for the provision of certain services offered by Noodz; however, in order to handle any requests by Users relating to such services, they will be asked to provide Personal Data, which will be processed solely for the related purposes and for the time strictly necessary.

Methods of processing 
Personal Data will be processed by means of the operations of collection, recording, organisation, storage, consultation, elaboration, modification, selection, extraction, comparison, use, interconnection, blocking, communication, erasure and destruction of Personal Data.
Personal Data will be processed mainly by automated means but also in paper form, using logic strictly related to the above purposes.

Nature of the provision of Users' Personal Data
The provision of Personal Data is optional, but it is in part necessary for Noodz to meet the User's needs in relation to the services offered by the Site and the purposes indicated above. Failure to provide, or partial or inaccurate provision of, Personal Data that are necessary for the performance of the requested service makes such performance impossible.
Failure to provide, or partial or inaccurate provision of, optional Personal Data that are not necessary has no consequences.

Categories of Personal Data processed 
In addition to the Personal Data provided directly by users (such as first name, surname, postal address, e-mail address, password, age, date of birth, sex, image, profession, marital status, etc.), when connecting to the Site, the computer systems and software procedures used to operate the Site automatically and indirectly acquire certain Personal Data whose transmission is implicit in the use of Internet communication protocols (e.g. IP addresses or domain names of the computers used by users connecting to the site, URI – Uniform Resource Identifier – addresses of the resources requested, the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the numerical code indicating the status of the response given by the server – successful, error, etc. – and other parameters relating to the User's operating system and IT environment). 
Such Personal Data are processed solely for the purpose of carrying out anonymous statistical surveys on the use of the Site and checking that it is functioning correctly, and are deleted immediately after processing. The Personal Data could be used to establish liability in the event of hypothetical computer crimes against the Site.

Categories of persons who may become aware of Users' Personal Data
Personal Data may be made known to employees or collaborators of the Controller or of Noodz in Italy and abroad who, acting under the direct authority of the latter, are appointed as Processors and/or Persons in Charge of the processing and will receive appropriate operating instructions in this regard.

Scope of communication or dissemination of Users' Personal Data 
Personal Data provided directly by Users by filling in the online forms may be communicated to external service providers entrusted with the management of Personal Data for the purposes for which the Personal Data were collected; Noodz shares the User's Personal Data to the extent necessary to enable such third-party service providers to provide the applicable service to Noodz or on its behalf (for example order fulfilment, payment services and processing, credit card management, debt collection, operation of the website and the e-commerce platform, support services, promotions, website development, e-mail services for sending e-mails and/or newsletters and/or SMS/WhatsApp messages on its behalf, analysis of Personal Data, etc.).
Such providers, whose details may be requested from the Data Controller indicated below, are appointed as Data Processors and must give appropriate operating instructions to their employees or collaborators who may become aware of the Personal Data.

Noodz does not share, sell, transfer or otherwise disclose the User's Personal Data to third parties, except as provided by law pursuant to Article 6(1)(c) of the GDPR, except where required for the purposes of the contract pursuant to Article 6(1)(b), or unless the User has expressly consented pursuant to Article 6(1)(a).

Users' rights under Article 7 of the Code and Article 15 GDPR 
The data subject has the right to obtain confirmation as to whether or not Personal Data concerning them exist, even if not yet recorded, and to have such data communicated in an intelligible form and to access their content.

The data subject has the right to be informed of:

• the source of the Personal Data;
• the purposes and methods of the processing;
• the logic applied in the case of processing carried out with the aid of electronic means;
• the identification details of the Controller, the Processors and the representative designated in the territory of the Italian State, where applicable;
• the persons or categories of persons to whom the Personal Data may be communicated or who may become aware of them in their capacity as designated representative in the territory of the Italian State, Processors or Persons in Charge of the processing. 

1. The data subject has the right to obtain:

• the updating, rectification or, where they have an interest therein, the integration of the Personal Data;  
• the erasure, anonymisation or blocking of Personal Data processed unlawfully, including data whose retention is not necessary in relation to the purposes for which the Personal Data were collected or subsequently processed;
• certification that the operations referred to in the preceding points have been brought to the attention, also as regards their content, of those to whom the Personal Data have been communicated or disseminated, except where this proves impossible or involves a manifestly disproportionate effort compared with the right protected.

1. The data subject has the right to object, in whole or in part:

• on legitimate grounds, to the processing of Personal Data concerning them, even if relevant to the purpose of the collection;
• to the processing of Personal Data concerning them for the purpose of sending advertising material or direct selling or for carrying out market research or commercial communications.

Where applicable, the data subject also has the rights set out in Articles 16-21 GDPR (right to rectification, right to be forgotten, right to restriction of processing, right to data portability, right to object), as well as the right to lodge a complaint with the Italian Data Protection Authority (Autorità Garante).

The above rights may be exercised directly or by granting, in writing, a proxy or power of attorney to natural persons or associations.

Retention of Personal Data
In compliance with the applicable laws, Noodz will use the Personal Data for the time necessary to fulfil the purposes for which they were collected (as described in the section "Purposes of the processing") or to meet the applicable legal requirements.

How to exercise your rights and obtain the list of Data Processors
The User may, at any time, exercise the above rights and obtain the complete list of Processors by sending an e-mail to the Data Controller's address, or a letter by ordinary or registered mail, or a certified e-mail (PEC). 
Furthermore, if the User initially gave consent, they may subsequently object to the processing for the purposes referred to in points 2 and 3 of the section Purposes of the processing by clicking on the specific "link" contained in each e-mail message or by contacting the Data Controller as indicated in the preceding paragraph.
