Returns and right of withdrawal (extract from the Terms and Conditions)

10) Right of withdrawal

10.1 Pursuant to Articles 52 et seq. of the Italian Consumer Code (Legislative Decree No. 206 of 6 September 2005), the Customer has the right to withdraw from the Sales Contract for the Product without incurring any costs other than the direct cost of returning the goods and without having to give any reason, provided that this takes place within the Withdrawal Period. The Withdrawal Period expires 14 calendar days after the day on which the Customer, or a third party other than the carrier and designated by the Customer, acquires physical possession of the Products.
The Consumer Code excludes the Customer's right of withdrawal in respect of the supply of goods which are liable to deteriorate or expire rapidly and the supply of sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery. Since the Products sold by Noodz may fall within the above categories, Noodz may assess on a case-by-case basis whether the Customer's exercise of the right of withdrawal is legitimate.
In such cases and, in any event, whenever the right of withdrawal has not been exercised in accordance with the applicable rules, Noodz shall notify the Customer accordingly within 7 working days of receipt of the Product, rejecting the withdrawal request. The Customer shall therefore not be entitled to any refund, and the Product shall remain available to the Customer for collection, which shall be arranged by the Customer and at the Customer's expense.

10.2 To exercise the right of withdrawal, the Customer must inform Noodz of their decision to withdraw by sending an e-mail to mail(at)noodz.it before the Withdrawal Period expires. In that communication the Customer must state the order number, the Product(s) in respect of which they intend to exercise the right of withdrawal, and their address.

10.3 Following such communication, the Customer shall return the goods without undue delay and in any event within 14 calendar days of the date on which the Customer communicated to Noodz their decision to withdraw. For this purpose, the date of shipment shall be decisive.
The Customer must return the Product to Noodz using a carrier of their choice. The shipping costs for returning the Products shall be borne by the Customer.

10.4 The refund granted by Noodz to the Customer in the event of a legitimate exercise of the right of withdrawal shall be equal to the purchase price of the Product(s) plus the delivery costs, and shall be made without undue delay and, in any event, within 14 days of the date on which Noodz is informed of the Customer's decision to withdraw from the contract. The refund shall be made using the same means of payment chosen by the Customer when placing the order.

10.5 The Customer shall be liable only for any diminished value of the goods resulting from handling of the Product other than what is necessary to establish the nature, characteristics and functioning of the Product. In the event of withdrawal, therefore, the refund amount shall be reduced by an amount equal to such diminished value of the Product. Noodz shall notify the Customer of this circumstance, and of the resulting reduced refund amount, by e-mail within 7 working days of receipt of the Product, indicating to the Customer the methods for paying the amount due as a result of the diminished value of the Product.
